AUSTIN GAMBLERS ANDRHINO USA CHAMPIONSHIP SWEEPSTAKES Official Rules NO PURCHASE OR PAYMENT OFANY KIND IS NECESSARY TO ENTER OR WIN. A PURCHASE OR PAYMENT WILL NOT INCREASEYOUR CHANCES OF WINNING. ODDS OF WINNING DEPEND ON THE NUMBER OF ELIGIBLEENTRIES RECEIVED DURING THE SWEEPSTAKES PERIOD. Void where prohibited bylaw, outside the United States, and in New York and Florida. Subject to allfederal, state and local laws, regulations, and ordinances. BY ENTERING THISSWEEPSTAKES YOU AGREE TO THESE OFFICIAL RULES.: 1. Sponsor The Austin Gamblers and Rhino USA Championship Sweepstakes (“Sweepstakes”) is sponsored by Austin Gamblers, 98 San Jacinto, Suite 520, Austin, TX 78701, USA and The Murrieta Rhino HoldCo LLC dba RHINO USA, 6907 Capital of Texas Hwy #210, Austin, TX 78731, USA (collectively, “Sponsor”). 2. Eligibility The Sweepstakes is open to individuals who meet the following criteria: (a) legal resident of and physically residing in one of the fifty (50) United States or the District of Columbia (excluding New York, Florida, Puerto Rico, Guam, American Samoa, United States territories, possessions, and protectorates, foreign based United States military installations and wherever restricted or prohibited by law; and (b) at least 21 years old as of the date of participation (“Entrant”). Sponsor’s employees, officers, and directors, or any of Sponsor’s parents, affiliates, subsidiaries, representatives, consultants, contractors, legal counsel, advertising, public relations, promotional, fulfillment, and marketing agencies, website providers, web masters (collectively, the “Promotion Entities”), and members of their immediate families (spouses, parents, siblings and children, regardless of where they live) and those living in the same household are not eligible to enter or win.
3. Sweepstakes Period The Sweepstakes will start at 7 a.m. Central Standard Time (“CST”) on September 16, 2024, and end at 11:59 p.m. CST on September 30, 2024 (the “Sweepstakes Period”). Entries must be received before the Sweepstakes Period ends to be eligible to win. All federal, state and local laws and regulations apply. Proof of submitting a Sweepstakes entry will not be deemed by Sponsor as proof of receipt of entry into the Sweepstakes. Any attempted form of entry into the Sweepstakes other than as described herein is void. Entries received before and/or after the Sweepstakes Period will be void. Sponsor's computer will serve as the official timepiece for the Sweepstakes.
4. How to Enter The entry method is online: each Entrant will visit https://austin-gamblers-site-ab2b2fe37d4e8f6c22.webflow.io/sweepstakes, provide their full legal name and email address on the web form, confirm Entrant is 21 years of age or older, and agree to these Official Rules. Questions, comments or complaints regarding this Sweepstakes must be directed to Sponsor. Upon taking all required steps, Entrant will receive one (1) entry into the Sweepstakes. As a condition of Entry, Entrant agrees that Entrant has not purchased any kind of Internet service whatsoever in order to participate in and/or enter the Sweepstakes. Message and data rates apply to use of mobile device for entry. Entrant may be charged by Entrant’s wireless carrier for participating via mobile device. It is therefore recommended that each Entrant consults with Entrant’s wireless carrier’s pricing plan before participating via mobile device. Not all mobile devices offer wireless Internet access; and wireless Internet access may not be available in all areas. LIMIT: One (1) entry per person during the Sweepstakes Period. Multiple participants are not permitted to share the same email address. Any attempt by any participant to obtain more than the stated number of entries by using multiple/different email addresses, identities, registrations or logins, or any other methods will void that participant’s entries and that participant may be disqualified. Any use of robotic, repetitive, automatic, programmed, or similar entry/play methods or agents (including, without limitation, sweepstakes entry services) will void all entries by that Entrant. In the event of a dispute over who is an Entrant or who an entry corresponds to, the authorized subscriber of the email account used to enter the Sweepstakes of the actual time that such information was received by Sponsor, will be deemed to be the entrant. The “authorized subscriber” is defined as the natural person who is assigned an email address by an Internet access provider, online service provider or other organization (e.g. business, education, institution, etc.) that is responsible for assigning email addresses for the domain associated with the submitted email address. If there is a dispute about who an email address belongs to, it will be deemed submitted by the email account holder. Promotion Entities may require an Entrant to show proof of being the authorized account holder. Entrants may be required to indicate their acceptance to the Official Rules where indicated at the time of entry; provided, however, that any Entrant’s participation in the Sweepstakes constitutes, and is deemed, such Entrant’s full and unconditional agreement to the Official Rules. All decisions of Sponsor are final and binding in all respects.
5. Drawing On October 1, 2024, in Austin, TX, Sponsor will conduct a random drawing from among all eligible entries received. All entries are subject to verification, confirmation and compliance with the Official Rules. Odds of winning depend on the number of eligible entries received during the Sweepstakes Period.
6. Winner Notification Sponsor will attempt to notify each potential winner via the email address provided in connection with the potential winner’s entry on or about the day of the random drawing. Each potential winner must respond within twenty-four (24) hours of notification attempt. Failure to respond to notification within the stated time will result in forfeiture of the prize. Awarding of any prize is subject to verification of potential winner’s eligibility and full compliance with these Official Rules. Except where prohibited, the selected potential winner may be required to complete and return to Sponsor or its designated agent an Affidavit of Eligibility and a Liability/Publicity Release Form (“Prize Release Forms”) within five (5) days of receiving the Prize Release Forms. Failure to return the signed Prize Release Forms within five (5) days following the date of delivery thereof may result in forfeiture of the prize. If a potential winner cannot be contacted as specified above, or if he/she fails to return the signed Prize Release Forms by the deadline specified above, or if a potential winner is deemed ineligible for any other reason in Sponsor’s sole discretion, the potential Winner will be disqualified and an alternate Winner may be randomly selected in his/her place from among all remaining eligible entries, time permitting. LIMIT: One (1) Prize per person, email address, or phone number.
7. Prizes [PRIZES]: flyaway trip for one (1) for winner and three (3) guests, which includes: (a) round-trip airfare from anywhere in the continental United States to and from Las Vegas, Nevada; (b) two (2) nights hotel accommodations at Park MGM and (c) 4 tickets to attend the PBR Teams Championship on Saturday, October 19th, 2024 at T-Mobile Center. Total approximate retail value of the Prize is Dollars ($5,000). Prizes are non-substitutable, non-transferable and not redeemable for cash by the winner. Sponsor may substitute a Prize for one of equal or greater value at Sponsor’s sole discretion. Resale of any prize by a winner is prohibited. Winner is solely responsible for any and all applicable fees and taxes associated with receipt and use of a Prize.
8. Travel All guests of winners, as applicable, will be required to execute a Release of Liability prior to departure. All travelers must have valid travel documents prior to departure (i.e., REAL ID, passport or other TSA-approved ID; visit www.tsa.gov for a list of TSA-approved IDs). All travel must be completed on date specified by Sponsor; dates of departure and return are subject to change. Certain restrictions and blackout dates may apply. Seat selection and timing of trip subject to availability and confirmation of reservations. All details, including exact seat locations (if applicable) and all prize components, will be determined by Sponsor in its sole discretion. Sponsor is not responsible if the event/flight is delayed, postponed or cancelled for any reason and winner will not be reimbursed. If any prize winner’s guest is a minor, the winner must be the guest’s parent or legal guardian.
9. Release By entering this Sweepstakes, each Entrant agrees to: (a) comply with and be bound by these Official Rules and the decisions of the Sponsor which are binding and final in all matters relating to this Sweepstakes; (b) release and hold harmless the Promotion Entities from and against any and all claims, expenses, and liability, arising out of (1) any incorrect or inaccurate information, whether caused by participants, printing errors or by any of the equipment or programming associated with or used in the Sweepstakes; (2) technical failures of any kind, including, without limitation, alterations, malfunctions, interruptions, cyber-attacks, hacks, or disconnections in phone lines or network hardware or software; (3) unauthorized human intervention in any part of the entry process or the Sweepstakes; (4) technical, human or any other error which may occur in the administration of the Sweepstakes or the processing of entries; and (5) any injury or damage to persons or property of any kind which may be caused, directly or indirectly, in whole or in part, from participant’s participation in the Sweepstakes, including, without limitation, invasion of privacy, defamation, slander, libel, violation of right of publicity, infringement of trademark, copyright or other intellectual property rights, personal injury, death, or damage to or loss of property, or the receipt or use or misuse of any prize. No more than the stated number of prizes will be awarded; and (c) indemnify, defend and hold harmless the Promotion Entities from and against any and all claims, expenses, and liabilities (including reasonable attorneys’ fees) arising out of or relating to an Entrant’s participation in the Sweepstakes and/or Entrant’s acceptance, use or misuse of any prize. Sponsor and Released Promotional Parties are not responsible if the Sweepstakes cannot take place or if any prize cannot be awarded due to travel cancellations, delays or interruptions of any kind, including, without limitation, due to acts of God, acts of war, natural disasters, weather or acts of terrorism.
10. Privacy By entering this Sweepstakes, each entrant agrees: (a) that the Sponsor may contact the Entrant by email accounts to administer and fulfill this Sweepstakes; (b) to Sponsor’s collection of Entrant’s personal information provided by Entrant and usage of the same based on the terms in these Official Rules; and (c) that Entrant read and accepts Sponsor’s privacy policy and terms of use.
11. Publicity Grant & Privacy Statement Entrant hereby gives Sponsor permission to use Entrant’s name, state, country, region of residence, and any other information or content provided by Entrant to Sponsor for promotional purposes and/or to announce the prize winner in online, email, print, or any other media, without payment or compensation to Entrant, except where prohibited by law, and to comply with legal requirements.
12. General Conditions Sponsor reserves the right to cancel, suspend and/or modify the Sweepstakes, or any part of it, for any reason whatsoever, including, without limitation, fire, flood, natural or man-made epidemic of health of other means, earthquake, explosion, labor dispute or strike, act of God or public enemy, satellite or equipment failure, riot or civil disturbance, terrorist threat or activity, war (declared or undeclared) or any federal, state or local government law, order, or regulation, public health crisis, order of any court or jurisdiction or if any fraud, technical failures or any other factor beyond Sponsor's reasonable control impairs the integrity or proper functioning of the Sweepstakes, as determined by Sponsor in its sole discretion. If the Sweepstakes is terminated before the designated end date, Sponsor will (if possible) select the prize winners in a random drawing from all eligible, non-suspect entries received as of the date of the event giving rise to the termination. Inclusion in such drawing shall be each entrant’s sole and exclusive remedy under such circumstances. Sponsor reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the Sweepstakes or to be acting in violation of these Official Rules or any other promotion or in an unsportsmanlike or disruptive manner. Any attempt by any person to deliberately undermine the legitimate operation of the Sweepstakes may be a violation of criminal and civil law, and, should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. Only the type and quantity of prizes described in these Official Rules will be awarded. The invalidity or unenforceability of any provision of these rules shall not affect the validity or enforceability of any other provision. In the event that any provision is determined to be invalid or otherwise unenforceable or illegal, these rules shall otherwise remain in effect and shall be construed in accordance with their terms as if the invalid or illegal provision were not contained herein. Sponsor's failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.
13. General Terms Sponsor reserves the right to terminate the Sweepstakes at any time and to cancel, suspend and/or modify the Sweepstakes, or any part of it, if any fraud, technical failures or any other factor beyond Sponsor’s reasonable control, including, without limitations, any cyber-attack or hack, impairs the integrity or proper functioning of the Sweepstakes or the awarding of the prizes, as determined by Sponsor in its sole discretion. Sponsor and its agencies are not responsible for lost, late, incomplete, damaged, stolen, misdirected, or illegible entries; lost, interrupted, or unavailable network, server, or other connections, garbled transmissions or miscommunications, telephone transmission problems; computer or software malfunctions or damage to a user’s computer equipment (software or hardware); technical failures; or other errors or malfunctions of any kind whether human, mechanical, electronic, or otherwise.
14. Disputes/Governing Law Entrant agrees that: (i) any and all disputes, claims and causes of action arising out of or connected with this Sweepstakes, or any prizes awarded, other than those concerning the administration of the Sweepstakes or the determination of winner, shall be resolved individually, without resort to any form of class action; (ii) any and all disputes, claims and causes of action arising out of or connected with this Sweepstakes, or any prizes awarded, shall be resolved exclusively by the United States District Court or the appropriate Texas State Court; (iii) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Sweepstakes, but in no event attorneys' fees; and (iv) under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrant and Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of the State of Texas, without giving effect to any choice of law or conflict of law rules (whether of the State of Texas or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of Texas.
